European Union. New versions and modification of various elements of the FP6 model contract

On 23 October 2003, the European Commission adopted new versions of various elements of the model contract for projects under the Sixth Framework Programme (FP6), including the general conditions and all Marie Curie Actions model contracts. Among the most important modifications of the general conditions is the one related to the prior notice requirement for granting access rights to third parties (Article II.35.1.b). According to the new provision, said notice requirement has been restricted. It applies when the potential grant of access rights to knowledge is not in accordance with the interests of developing the competitiveness of the dynamic knowledge-based European economy. The wording of the provision does not indicate clearly whether this requirement has also to be fulfilled where the potential grant of such access rights is inconsistent with ethical principles.

In addition, the Commission adopted form B (request for accession of a new contractor to the contract) and different forms C which contain the financial statements for the different types of projects.

The new elements of the model contract are available on the website of the Model Contract Working Group and on a specific IPR-Helpdesk web page indicated below.
