European Union. Proposals of the Commission on the Community patent jurisdiction

On 23 December 2003, the European Commission adopted two proposals regarding the Community patent jurisdiction.

The first one is concerned with both the establishment, within the European Court of Justice (ECJ), of the Community Patent Court and the competence of the Court of First Instance as appeal instance against the decisions of this new Court. The second one provides the ECJ with the jurisdiction to decide in disputes relating to Community patents.

It is now for the European Council to decide on these proposals.
