The Council Regulation No 422/2004, amending the Regulation No 40/1994 on the Community trade mark, has been published in the issue L 70 of the Official Journal of the European Union, on 9 mars 2004.
The new regulation contains various significant amendments, concerning, among others, Article 5 (persons who can be proprietors of Community trade marks), Article 7(1) (Absolute grounds for refusal), Article 21 (Insolvency proceedings), Article 39 (Search) and Article 131 (Independence of the members of the Boards of Appeal).
Furthermore, some new Articles have been added to the Community trade mark Regulation, enhancing thus the overall functioning of the system.
