European Union. ECJ judgments in the Henkel, Campina Melkunie and Koninklijke KPN Nederland cases concerning the matter of trade marks
On 12 February 2004, the European Court of Justice (ECJ) answered the preliminary questions concerning the matter of trade marks referred to it in the Henkel, Campina Melkunie and Koninklijke KPN Nederland cases.
When the Henkel case refers to the distinctiveness of the three-dimensional signs made up of the packing of the product, the two other cases principally refer to the issue of the distinctiveness of a sign made up of a combination of two descriptive words.
