| European Union. The Regulation concerning the rules for participation in FP6 and for dissemination of research results and the Regulation concerning the rules for participation in FP6/Euratom have been adopted

On 5 November 2002, the Council adopted the Regulation concerning the rules for the participation of undertakings, research centres and universities in the sixth framework programme of the European Community (FP6) and for the dissemination of research results by qualified majority with the Portuguese delegation abstaining. On the same date, the Council also adopted the Regulation concerning the rules for the participation in the implementation of the sixth framework programme of the European Atomic Energy Community (FP6/Euratom). The documents that were finally adopted have not yet been published but are believed to be identical to the latest published drafts of the Regulations dated 22 October 2002.
Both Regulations will enter into force on the third day following their publication in the Official Journal of the European Communities and will be binding and directly applicable in all Member States.
The European Institutions have take account of previous experience and have designed rules that allow enduring effects for any project, and more flexibility and autonomy for consortia, in line with the features of the new instruments, Integrated Projects and Networks of Excellence - which imply more flexibility and necessity for self-regulation.
Some innovations may be noted: It is now possible to modify a consortium's membership whenever necessary. Regarding IPR issues, the situation is also very positive. The partners will be able to self-regulate quite a number of IPR issues among them, and the consortium agreement gains relevance. The interests of the participant are given more consideration; and, for example, regarding access rights (licences and user rights) the regime is significantly simplified and unified. Any participant may explicitly exclude specific information and IPR from the obligation to grant access rights before signing the grant agreement with the Commission.
